This programme is designed for front line staff, who have an interest in developing their knowledge in these important areas of legislation. The course covers everything you need to know to feel confident in working within the frameworks. It includes real life case studies drawn down from the Court of Protection, and a brief look at some of the changes currently going through parliament.

  • Why and how the MCA (2005) and the Deprivation of Liberty Safeguards were introduced, and the relationship between the two
  • What the Act means by “capacity”, how it is assessed, and who is competent to make the assessment

  • The difference between restriction of liberty and deprivation of liberty, and how these occur in different settings

  • How criticisms and court rulings have changed understanding and interpretation of the MCA and Deprivation of Liberty Safeguards, and likely changes in future
